These terms govern your use of the website mybarn.com and the applications and services Barn Inc. (“Barn”, “we”, “us”) operates (together, the “Services”). By using the Services, you agree to these terms. If you have any questions, write to us at privacy@mybarn.com.

Using the Services

You may use the Services only in compliance with these terms and applicable law. Some parts of the Services may let you connect third-party accounts or services; if you do, you are responsible for having the right to connect them, and your use of those third-party services is governed by their own terms and privacy policies.

Acceptable use

When using the Services, you agree not to:

• interfere with or disrupt the Services, or access them by any means we have not made available;
• probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure;
• copy, scrape, or harvest content or data from the Services except as we allow;
• reverse engineer or attempt to extract the source code of any non-public part of the Services; or
• use the Services to violate the law or the rights of others.

Ownership

The Services, including their design, text, graphics, and software, belong to Barn or our licensors and are protected by intellectual-property laws. These terms do not grant you any right to use the Barn name, wordmark, or branding. If you send us feedback or suggestions, we may use them without obligation to you.

Disclaimer of warranties

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, Barn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. To the fullest extent permitted by law, Barn’s total liability for any claim relating to the Services is limited to the greater of one hundred U.S. dollars (US$100) or the amount you paid us for the Services in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

Termination

You can stop using the Services at any time. We may suspend or end your access to the Services if you violate these terms or if we reasonably believe it is necessary to protect the Services or others.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute relating to these terms or the Services will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

Changes to these terms

We may update these terms from time to time. If we do, we will post the updated version here and revise the effective date above. If a change is significant, we will provide more prominent notice. Continuing to use the Services after a change takes effect means you accept the updated terms.
